Terms and Conditions for Lucy Stone Real Estate Copywriting

These Terms and Conditions ("Terms") govern the use of the services provided by Lucy Stone Real Estate Copywriting ("we", "our", or "us") as a freelance real estate copywriter. By accessing or using our services, you ("you" or "the client") agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using our services.

1. Services Provided

We offer real estate copywriting services including but not limited to property descriptions, website content, blogs, and other related content for real estate agents, property developers, and other businesses in the real estate sector.

2. Pricing and Payment

  • Pricing: All services will be quoted prior to commencement, and pricing will be based on the scope of work discussed. Prices may vary based on the complexity and length of the project.

  • Payment Terms: A deposit of 25% may be required before work begins, with the balance due upon completion or as otherwise agreed. Invoices will be issued and are payable within 7 days.

  • Late Payments: If payment is not received by the due date, a late fee of $15 will apply, and work may be suspended until payment is received.

  • Refunds: In accordance with Australian Consumer Law, if the service provided is faulty, not as described, or not delivered in a timely manner, you may be entitled to a remedy, including a refund or revision of services.

3. Client Responsibilities

  • Provide Accurate Information: You agree to provide all necessary information and materials required for the completion of the work. This includes property details, project specifications, and any other relevant information.

  • Approval of Work: You are responsible for reviewing and approving drafts and final content. Feedback must be provided in a timely manner to ensure the project is completed as agreed.

  • Compliance with Laws: You must ensure that the content you request does not violate any laws or third-party rights, including intellectual property rights, defamation, or privacy laws.

4. Intellectual Property

  • Ownership of Content: Upon full payment, ownership of the final delivered content will transfer to you, unless otherwise agreed in writing. However, we retain the right to use the work for promotional purposes in our portfolio or other marketing materials.

  • Licensing of Pre-Existing Content: If the work involves using third-party materials or licensed content (e.g., stock images), you will be informed of the licensing terms, and any additional fees may apply.

5. Consumer Guarantees

As a consumer under Australian Consumer Law, you have the right to:

  • Guarantee of Services: We will provide services with due care and skill, and they will be fit for the purpose described in our agreement. If the services are not as promised, you have the right to request a remedy (e.g., repair, replacement, or refund).

  • Misleading or Deceptive Conduct: We will not engage in any misleading or deceptive conduct, and any representations made to you will be truthful and accurate.

  • Right to a Refund or Repair: If services do not meet consumer guarantees, you may be entitled to a repair, replacement, or refund.

6. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our liability is limited to the total amount paid for the services that gave rise to the claim.

7. Privacy and Confidentiality

9. Dispute Resolution

In the event of a dispute, we encourage you to first contact us directly to attempt to resolve the matter amicably. If a resolution cannot be reached, we may suggest mediation or other dispute resolution methods. If necessary, legal action may be taken in accordance with Australian law.

10. Governing Law
